DOC - Prison Rape Elimination Act

Prison Rape Elimination Act (PREA)

On September 4, 2003, President George W. Bush signed into law the Prison Rape Elimination Act (PREA) of 2003 (P.L. 108-79). The goal of PREA is to eradicate prisoner rape in all types of correctional facilities in this country.  U.S. Department of Justice, Prison Rape Elimination Act, Prisons and Jails Standards (DOWNLOAD Copy)

It is the goal of the Hillsborough County Department of Corrections (HCDOC) to encourage and maintain a healthy environment for all visitors, inmates, and staff. The department has a ZERO TOLERANCE approach for addressing any and all forms of sexual abuse, sexual harassment and/or retaliation against anyone who reports and/or files claims regarding such incidents.

WHAT YOU NEED TO KNOW:

•    Under NH Law and HCDOC policy, an inmate cannot legally consent to sexual contact with anyone while incarcerated.

•    An inmate can have NO sexual contact with another inmate, HCDOC staff, visitors, volunteers, and/or contractors.

•    It is NEVER appropriate for HCDOC staff, visitors, volunteers, and/or contractors to make sexual advances or comments, or to engage in sexual contact with an inmate, or to retaliate against those who file such claims.

•    Including those persons under the supervision of Electronic Monitoring and Pretrial Services.

ALL REPORTED INCIDENTS WILL BE INVESTIGATED:

If an inmate you know has been sexually assaulted, subjected to sexual harassment, threatened for sex, promised favors or protection in exchange for sex, or retaliated against for reporting such, please let someone know. To report an incident, you or the inmate may use any of the following options:
